Each party shall bear its own costs and attorneys' fees, except as otherwise required by law or the AAA's rules.
14.3 Class Action Waiver
YOU AND VIA 313 AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of the arbitration provision shall be null and void.
14.4 Jury Trial Waiver
BY AGREEING TO THESE TERMS, YOU AND VIA 313 EACH WAIVE THE RIGHT TO A JURY TRIAL WITH RESPECT TO ANY DISPUTE ARISING UNDER OR RELATING TO THESE TERMS OR THE SERVICES, TO THE EXTENT PERMITTED BY APPLICABLE LAW.
